The Italian law provides that all vehicles must be insured so that, in the event of a road accident, the injured party may receive compensation.
In the case of vehicles which are not identified and not insured, Italian law has provided for the establishment of a fund, the so-called Fondo di garanzia per le vittime della strada (Guarantee Fund for Road Victims), born with the purpose of compensating the road victim of vehicles not compliant with the insurance.
The guarantee fund operates throughout Italy by means of determined insurance companies, one or more for any Italian Region. These insurance companies are responsible for determining the damage and for recovering the compensation directly from the damaging party (if identified).
The fund operates only in the following circumstances:
- Unidentified vehicle;
- Not insured vehicle;
- Vehicle insured by a company in bankruptcy proceedings;
- Vehicle in circulation against the will of the owner.
The claim for compensation coming from a road accident shall be filed by stating the description of the accident, the data of the vehicles involved and personal details of the people involved in the accident.
